Liability Waiver: By purchasing this product, you accept full responsibility for any damage or harmful consequences that may result from the product. You understand that you waive the right to sue and seek compensation for damages that may arise from the use of the product in question, regardless of whether the product has been used properly or misused. You also acknowledge that all products created, manufactured, or distributed by Darwin EV, LLC are provided on the condition that its users accept full responsibility for any ill effects the product may cause.

Product Servicing: Darwin EV, LLC products are built to last. We stand behind the quality of our batteries and will address any manufacturer-related issues. Upon purchase, the customer agrees to take all safety precautions when operating and caring for their product, including maintenance and proper storage of lithium-ion battery packs.

Battery Maintenance: Store in a dry place. When not riding for long periods, keep battery charge between 50% and 80%. For best results, always charge after riding — do not store a depleted battery.

Handling of Lithium-ion Battery Cells – Risks and Precautions: Misusing or mishandling lithium-ion batteries can pose a serious risk of personal injury, property damage, or death. Batteries may explode, burn, or cause a fire if misused or mishandled. Only use with proper circuitry in a protected battery pack. Only use within manufacturers’ listed specifications.

Shipping Policy: Shipping and processing times can vary, depending on the
product. Most orders ship within 1 day and take about 1-4 days in
transit when shipped within the continental United States. Cut-off time:
4:00pm PT (7:00pm ET) Monday – Saturday.

Lead Times: Some products have lead times to allow for processing and/or clearance, in addition to transit times. It is possible to receive your items sooner. Here are our official lead times for the following product types:

• EWatt Batteries, Lids, Chargers: 10 days
• Forks, Shocks: 5 days
• Custom Wheel Sets: 21 days

Signature Required: Shipping of high-value items requires a signature from an adult (18+). Without a signed delivery receipt, the driver will be unable to complete the delivery.

Return Policy: We accept returns on new, unused batteries in original packaging. All battery sales outside the lower 48 states (US) are final and cannot be refunded or returned. Returns must be initiated within 30 days from the date of purchase. Eligible returns must be made by mail. Upon approved request, a return label will be made available for download to print, free of charge. Refund processing may take up to 7 days. Returns are subject to banking processing fees.

Restocking Fee: There is a 25% restocking fee for any battery returns and any battery order cancellations made after 72 hours of purchase.
