Terms and Conditions for Darwin EV, LLC

Liability Waiver

By purchasing a product from Darwin EV, you accept full responsibility for any damage or harmful consequences that may result from the product(s). You understand that you waive the right to sue and seek compensation for damages that may arise from the use of the product in question, regardless of whether the product has been used properly or misused. You also acknowledge that all products created, manufactured, or distributed by Darwin EV, LLC are provided on the condition that its users accept full responsibility for any ill effects the product may cause.

Product Servicing

Products sold by Darwin EV are built to last. We stand behind the quality of our products and we are happy to address any manufacturer-related issues. Upon purchase, the customer agrees to take all safety precautions when using and caring for our products, including maintenance and proper storage of lithium-ion battery packs, for example.

Handling of Lithium-ion battery cells – Risks and Precautions

Misusing or mishandling lithium-ion batteries can pose a serious risk of personal injury, property damage, or death. Batteries may explode, burn, or cause a fire if misused or mishandled. Only use with proper circuitry in a protected battery pack. Only use within manufacturers listed specifications.

Shipping Policy

Shipping and processing times can vary, depending on the product. Most orders ship within 1 day and take about 1-4 days in transit when shipped within the continental United States. Cut-off time: 4:00pm PT (7:00pm ET) Monday – Saturday.

Lead Times
Some products have lead times to allow for processing and/or clearance, in addition to transit times. It is possible to receive your items sooner. Here are our official lead times for the following product types:

    • EWatt Batteries, Lids, Chargers: 30 days
    • Forks, Shocks: 5 days
    • Custom Wheel Sets: 21 days

Signature Required
Shipping of high-value items requires a signature from an adult (18+). Without a signed delivery receipt, the driver will be unable to complete the delivery.

International Orders
Orders shipped outside of the continental United States may be subject to import duties, taxes, and customs fees imposed by the destination country. These charges are not included in the order total and are the responsibility of the customer.

Return Policy

We accept returns on new, unused products in original packaging. Returns must be initiated within 30 days of the delivery date. Items must be unused, uninstalled, and in original packaging. Returns must be approved prior to being sent back. Upon approved request, a return label will be made available for download to print, free of charge.

Once received and inspected, refunds are processed within 5–7 business days.

Refunds may be subject to a 3-5% processing fee.

Battery Return Policy

All battery returns must be unused and in original packaging. Returns outside the lower 48 states (U.S.) are final sale. Due to hazmat shipping requirements, all battery returns are subject to a 25% restocking fee.

Non-Returnable Items

The following items are not eligible for return:

  • Installed or used products
  • Damaged items not related to shipping
  • Custom or special-order items
  • Opened or used electrical components

Additional Terms for Returns

Darwin EV reserves the right to deny any return that does not meet the above conditions.

Restocking Fees

Due to handling, shipping, and inventory costs, the following restocking fees apply:

  • Batteries: 25%
  • Suspension (forks, shocks, springs): 20%
  • Electric Bikes: 8%
  • Controllers: 10%
  • Motors: 15%

Restocking fees are deducted from the total refund amount.

Cancellation Fee

A 3-5% processing fee may be charged for order cancellations.

Limited Warranty

Darwin EV (“we,” “us,” or “our”) offers a limited warranty on certain products, including batteries, motors, controllers, and related components. By purchasing from our website or an authorized dealer, you agree to the following terms:

Warranty Coverage

Our limited warranty covers defects in materials and workmanship under normal use and conditions for a period specified at the time of sale. Coverage duration and conditions may vary by product.

    • Warranty coverage applies only to the original purchaser of the product.
    • Warranties are non-transferable. Ownership changes void any remaining warranty coverage.

Exclusions

Warranties DO NOT cover:

    • Normal wear and tear
    • Damage due to misuse, abuse, neglect, accidents, or acts of nature
    • Improper installation or use with incompatible parts
    • Unauthorized modifications or third-party repairs
    • Use in applications not intended by the manufacturer

Installation Disclaimer

High-voltage components such as batteries and controllers must be installed by qualified technicians. Any damage or injury resulting from improper installation is the sole responsibility of the purchaser or installer.

Limitation of Liability

Darwin EV shall not be held liable for any indirect, incidental, or consequential damages, including but not limited to:

    • Loss of use
    • Loss of business or revenue
    • Property damage
    • Personal injury

Your use of our products is at your own risk. By purchasing from us, you agree to assume all responsibility for proper installation, maintenance, and safe operation.

Support for Secondhand Products

Darwin EV does not guarantee support for secondhand products. Warranty and technical support are intended for the original purchaser only.
